1. Who we are and what these terms cover
This website is operated by Swiss Motion Technologies SA, Avenue de Longemalle 9, CH-1020 Renens, Switzerland (“MotionTech”, “we”, “us”). These terms cover your use of this website only; ordering our products is governed separately (section 3). By using the website you accept these terms. If you do not accept them, please do not use it.
2. Information, not medical advice
The website presents MotionTech products, textile designs, clinics and supporting material, including the Your® Journey video library. It is general information. It is not medical advice, a diagnosis or a recommendation for any individual. Whether a product is clinically suitable for a person is decided by a qualified prosthetist together with that person. Patient stories, case reports and testimonials describe individual experiences and do not predict anyone else’s result. For any health concern, speak to your healthcare professional.
3. Products, ordering and availability
Your® Liner and Your® Sleeve are custom-made medical devices. They can be ordered only by certified prosthetists, through our ordering platform and not through this website. Each order is governed by the terms and conditions in force for your territory and by our order confirmation; those documents, not these terms, decide warranty, delivery, liability and remedies.
Forms on this website (for example a Demo Stand request, a partner application, a training request or “Tell my prosthetist”) are requests, not orders. No contract is formed until we confirm in writing. Products are not available in every country, and what you see depends on your country. Specifications, options and availability can change. Lead times are indicative and not guaranteed.
4. Using the website
Please use the website lawfully and in good faith. In particular, do not:
- give false details in a form, or send a form using someone else’s details without their knowledge;
- try to gain unauthorised access to the website or its systems, or disrupt it, including by automated bulk requests;
- copy the website’s content in bulk by automated means;
- send unlawful, offensive or harmful content.
We may block access or remove content if these rules are broken. Forms are for genuine enquiries only; we use the details you send as described in our Privacy Policy.
5. Your® Journey videos
The Your® Journey video library is free and for your personal, non-commercial use. Access asks for a short form. The videos, and tips shared by other users, reflect experience only. They do not replace advice from your prosthetist or another healthcare professional, and you should not change or stop treatment because of them.
If you have pain, lasting redness, a wound, a fever or anything unusual on your residual limb, see a healthcare professional without delay. In an emergency, call the emergency services.
6. Intellectual property
The content of this website (text, images, films, diagrams, textile designs, and the MotionTech name and logos) belongs to MotionTech or its licensors and is protected by copyright and trade mark law. You may view it, print it for your own use and share links to it. You may not copy, republish, sell or adapt it commercially without our written permission.
The people appearing in the videos consented to their publication in this context. Republishing those images elsewhere would infringe their rights.
7. Other providers’ services and websites
The website links to services and sites we do not control, for example maps, the ordering platform, our careers portal and social networks. We are not responsible for their content or practices, and their own terms and privacy policies apply when you use them. Content from other providers loads on this website only when you choose (see the Cookie Policy).
8. Availability and changes
We try to keep the website accurate and available, but we do not promise that it is free of errors or always available. We may change, suspend or withdraw any part of it at any time.
9. Liability
Nothing in these terms limits liability that cannot be limited by law, in particular liability for intent or gross negligence, for injury to life, body or health, or under mandatory product-liability law. Subject to that, and as far as the law allows, we are not liable for indirect or consequential loss, or for loss caused by the website being unavailable or by your reliance on information on it. Your mandatory consumer rights are not affected.
10. Privacy and cookies
How we handle personal data is described in our Privacy Policy. Which cookies and similar technologies the website uses is described in our Cookie Policy. These terms change neither.
11. Changes to these terms
We may update these terms. The version published on this page applies from the date shown below. If you keep using the website after a change, you accept the new version. Orders are not affected: the terms for your territory apply to them.
12. Governing law and jurisdiction
These terms are governed by Swiss law. The courts of the Canton of Vaud, Switzerland, have jurisdiction, unless mandatory law gives you the right to bring a claim elsewhere. Consumers in the EU keep the protection of the mandatory rules of the country where they live and may bring claims before the courts there.
If any provision of these terms is held invalid, the remainder continues to apply.
